Terms of Service

By purchasing, installing, or using Touchscreen Gestures ("the Software"), you agree to the following Terms.

1. Licence Grant

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the Software on up to two (2) computers that you own or control, with up to eight (8) connected USB touchscreen devices per computer. The personal licence is granted for the version of the Software purchased and is governed by these Terms, including §12 (Service Availability).

Volume and business licences purchased through our volume/bulk pricing are separate per-seat licences: each licence key activates one (1) computer. A volume order of N licences covers N computers total, not 2N. Unless stated otherwise in writing, all other Terms apply equally to personal and volume/business licences.

3. Free Trial

The Software includes a seven (7) day free trial period during which all features are available. Upon expiration of the trial period, a valid licence key is required for continued use. No payment information is collected during the trial.

4. Price, VAT & Payment

All prices are in Euros (EUR) and include applicable taxes. All payments are processed by Stripe Payments Europe Limited (Ireland); we do not store or have access to your payment card information.

5. Refund Policy

We offer a full refund within fourteen (14) days of purchase, no questions asked. To request a refund, reply to your purchase receipt email or contact [email protected] from the email address used at checkout. Refunds are processed within one business day via the original payment method (card refunds typically appear within 5–10 business days, depending on your bank).

Upon issuance of a refund, all licence keys associated with the refunded order are automatically revoked. For bulk/volume orders, refunds are issued for the full order; partial refunds of individual keys within a bulk order are handled case-by-case at our discretion.

6. EU Consumer Right of Withdrawal — Express Waiver

This section applies if you are a consumer residing in the European Union. Under Article 9 of Directive 2011/83/EU on consumer rights, you normally have a period of fourteen (14) days in which to withdraw from a distance contract without giving any reason.

Important: By accepting these Terms of Service at checkout and completing your purchase, you expressly request that we begin performance of the contract immediately (delivery of your licence key and installer link by email on payment), and you acknowledge that you thereby lose your right of withdrawal once that performance has begun, in accordance with Article 16(m) of Directive 2011/83/EU and Article 3ιβ(m) of Greek Law 2251/1994 (digital content not supplied on a tangible medium, where performance has begun with your prior express consent and acknowledgement of the loss of the withdrawal right). Clicking "Proceed to Payment" after ticking the consent box constitutes that prior express consent.

This waiver does not affect your statutory rights regarding non-conforming or defective digital content (see §10). It also does not affect our voluntary 14-day refund policy described in §5 above, which we offer independently of any statutory obligation.

7. Updates & Conformity

Your licence includes free updates within the major version purchased (e.g., all v1.x releases). Future major versions may require a separate licence or paid upgrade offer.

We will inform you of, and supply, security and conformity updates that are necessary to keep the Software in conformity with the contract during the reasonably expected lifetime of the version you purchased, as required by Article 8(2) of Directive (EU) 2019/770.

8. System Requirements

The Software requires macOS 13 (Ventura) or later and a USB touchscreen device that conforms to the HID Digitizer or HID Mouse protocol. Compatibility with all touchscreen hardware is not guaranteed. Please use the 7-day free trial to confirm compatibility with your specific hardware.

9. Disclaimer of Warranties

Except as required by non-waivable consumer-protection law, the Software is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the Software will work with every USB touchscreen or in every macOS configuration. We are not responsible for any damage arising from the use of the Software, to the maximum extent permitted by applicable law.

10. Limitation of Liability — Consumer Rights Savings Clause

Our total aggregate liability is limited to the amount you paid for the licence. We are not liable for indirect, incidental, or consequential damages.

Sections 9 and 10 do not limit or exclude any non-waivable statutory rights you may have as a consumer under Directive (EU) 2019/770 on the supply of digital content, Greek Law 2251/1994 (as amended by L. 4967/2022), or the mandatory consumer-protection laws of your country or state of residence — including the two-year legal guarantee of conformity. In particular, if the digital content is not in conformity with the contract you may require it to be brought into conformity, a price reduction, or termination of the contract, in accordance with Articles 5ζ–5ι of Greek Law 2251/1994.

11. Termination

We may terminate your licence if you violate these Terms (e.g., sharing your key or attempting to crack the Software). Upon termination, you must stop using the Software.

12. Service Availability

One-time download with locally-stored authorization. The Software is delivered as a one-time download. Authorization is stored on the device after activation and is verified locally. Online services that support the Software — including license activation, automatic update delivery, and diagnostic uploads — may change or be discontinued at any time without prior notice.

Continued use after server changes. If we discontinue or substantially change the online services, copies of the Software you have already installed and authorized will continue to function on the device they were installed on, subject to the operating system and your hardware. We cannot guarantee that re-activation on a new device will remain possible after the online services end.

No additional refund obligation. Refund eligibility is governed solely by §5 above (14-day refund window). No additional refund obligation arises from changes to or cessation of the online services. This clause does not limit any non-waivable statutory rights you may have as a consumer under §10.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of Greece. Any disputes will be subject to the exclusive jurisdiction of the courts of Greece, save that consumers domiciled in the European Union retain the right to bring proceedings in the courts of their country of domicile under Articles 17–18 of Regulation (EU) 1215/2012, and to rely on the mandatory provisions of consumer-protection law of their habitual residence under Article 6(2) of Regulation (EC) 593/2008. Consumers in the United States retain any non-waivable consumer-protection rights they may have under the laws of their state of residence.

Alternative Dispute Resolution: EU consumers may refer disputes to the Greek Consumer Ombudsman (Συνήγορος του Καταναλωτή), Leoforos Alexandras 144, 11471 Athens, www.synigoroskatanaloti.gr, [email protected]. We will engage with that body in good faith but are not obliged to do so.

14. Changes

We may update these Terms from time to time. Continued use of the Software after changes constitutes acceptance of the new Terms.

15. Accessibility

Touchscreen Gestures is committed to making this website usable by the widest possible audience, including people with disabilities. This section is published in accordance with the European Accessibility Act (Directive (EU) 2019/882).

Conformance target. This site targets Web Content Accessibility Guidelines 2.1 Level AA (WCAG 2.1 AA) and EN 301 549 v3.2.1, the European harmonised standard that incorporates WCAG 2.1 AA.

Measures we take. Semantic HTML landmarks (<nav>, <main>, <footer>) and a skip-to-content link at the top of every page; visible focus indicators on all interactive elements; text colour contrast of at least 4.5:1 for body text; modal dialogs use role="dialog" and aria-modal="true" with keyboard focus trap and return-focus; forms use associated <label> elements and sensible autocomplete attributes; decorative images use alt=""; no content is conveyed by colour alone.

Enforcement procedure. If you are not satisfied with our response to an accessibility complaint, you may refer the matter to your national accessibility-enforcement body designated under Directive (EU) 2019/882.

Contact. If you encounter an accessibility issue on this site or need content in an alternative format, email [email protected] with the subject "Accessibility". We aim to acknowledge accessibility requests within 5 business days and to resolve or respond substantively within 30 days.

16. Trader Identification

This section provides the trader-identification information required by Article 5 of EU Directive 2000/31/EC (the E-Commerce Directive), as transposed into Greek law by Presidential Decree 131/2003, Article 4. It is also the contact point for these Terms.
